Have any of the HOAs in CALIFORNIA had any experiences regarding the Davis-Stirling Act? While it is true that the Davis-Stirling Act demonstrates good models for organization and procedures, are the HOAs of tracts in National Forests governed by the Act?

Hi there - I just posed this same question via the NFH help email. Some recent internet research implied that we are not subject to this act because we are on federal, not state land. However, I'm trying to validate this information (without paying big $$$ to an attorney). Have you learned anything more since you posted this question?
Shelley Horwitz of Silver Creek tract in Olympic Valley, CA
sahorwitz@comcast.net

Sorry for the late response, Shelley. I was out of state when you sent that and it kind of got lost in my "follow up when you get home" folder. I have not learned anything more since posting that. Surely there is an HOA in California that can give some input but haven't gotten anything as yet. Please keep me updated if you have further information and I will do the same. Do you have any links to the info presented that says because we are on federal land, that it does not apply? That certainly makes sense to me and I would be elated if that's the case!
Beverly Long (Silverthorn Summer Homes Tract in Shasta-Trinity National Forest)

Hi all, I'm almost certain (but would love for an attorney to chime in), Davis-Stirling does not apply to the cabin tracts because there is no common ownership of real estate (land). Below is an excerpt from (a newly AI-enhanced google search since the last time this question was asked ;-

Desiree La Maggiore
NFH Field Director
Board Member, Salt Creek Summer Homes Association (Shasta-Trinity NF)

Does Davis Stirling Act apply if there is no common real estate?

No, the Davis-Stirling Act does not apply to a development without common real estate because the Act governs common interest developments (CIDs), which by definition require ownership of a separate interest coupled with a shared interest in common area property. A development without any common area is not a CID and therefore not subject to the Act.

Definition of a CID: A common interest development is specifically defined as a development where ownership of a separate interest is combined with a shared interest in common areas.

Exemption for developments without common area: The Davis-Stirling Act explicitly states that it does not apply to a real property development that does not contain common areas.

Consequence: If there are no common areas, the development is not considered a CID under the Act, and its governing documents and the association's operations are not subject to the Act's requirements.
