Just curious as to cabin owners that are being taxed by their county on value of the land your cabin sits on. Counties receive 25% of Special Use Fees each year under the Schools and Roads clause in the original ACT. Seems like double taxation.

The practice of allocating a percentage of the Recreation Residence annual permit fees to local counties via Secure Rural Schools laws ended approximately 20 years ago. Rural counties do receive funds from the Federal government through the Secure Rural Schools Act (and other similar laws), but the funds are appropriated by Congress from the General Treasury and not from any specific program revenues. The purpose of these appropriations are to help fund necessary local services in certain rural counties where a significant portion of county is federal lands which are not subject to taxation by state/local jurisdictions.

At least 3 states, CA, WA, & TN apply a property or excise tax to recreation residence permit holders for the use of the land they don't own. This is in addition to a property tax on the cabin structure. Unfortunately, states have broad authority to pass laws to apply property and other forms of taxes for almost anything they want. Limited attempts by cabin owners to change state property tax laws have not been successful to date. NFH believes there are valid arguments to lobby for removing recreation residence land uses from these state imposed tax laws, but the "double taxation" argument probably isn't one of them.

Our cabin is in the Arapaho-Roosevelt NF in Colorado. It is also in Boulder County. I am assessed a property tax by Boulder County for land that I do not own. Is there a way to fight this?

Thank you,
Sherri Bornhoft
